B.C. woman heading to jury trial on murder charge

A B.C. woman has had a preliminary hearing on a second-degree murder charge related to the fatal stabbing death of a man in East Vancouver.

Vancouver Police Department officers responded just past midnight Oct. 3 to a residential building on Kingsway Avenue, in the Joyce-Collingwood area, after a man had been stabbed.

Brian Mathew Clayton, 34, died from his injuries before he could be transported to hospital.

Dolly Patricia Capoose, 28, was arrested the next day.

She was released on bail June 4 on a $1,000 surety and an order that she reside at a drug treatment centre.

She is not allowed to be in Vancouver.

Police believed the two knew each other.

Capoose pleaded not guilty in February and elected trial by B.C. Supreme Court judge and jury.

A preliminary hearing was held July 16.

Capoose’s name did not appear on the July 16 court docket. The Criminal Code of Canada ban section cited on the docket is 517 (1).

A court notice to the media and publication describes a 517 ban as follows: “An order bans publication of the evidence and information given to the court during a bail hearing, as well as reasons given by the judge, until the accused is discharged or, if ordered to stand trial, the trial has ended.”

The section does not cover naming an accused yet names are routinely removed from court dockets.
